Acceptance of Terms

These Terms of Service and Office Policies ("Terms") govern your use of the doctorqazi.com website ("Site"), your purchase of services and products, your participation in our Loyalty Program, rewards, and promotional programs, and any submission of information through forms, quizzes, contact inquiries, or promotional sign-ups on our Site.

These Terms apply universally to all digital platform interactions, online transactions, and website submissions, as well as all physical, in-office purchases, clinical evaluations, consultations, promotional program interactions, and medical or aesthetic treatments provided physically at our center location(s). By accessing this Site, submitting any form or inquiry, providing your contact information for promotional or educational materials, booking an appointment via any operational channel (online, telephonic, electronic message, or in-person walk-in), making any purchase, or receiving any service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must discontinue use of the Site and our clinical or retail services immediately.

You confirm that you are at least 18 years of age and legally capable of entering into a binding contract. If you purchase or schedule services on behalf of another person, you represent and warrant that you have the legal authority to act on their behalf and to bind them to these Terms.

1. Scope and Patient Representations

1.1 Patient Representations

You represent that all information you provide to Qazi Cosmetic Clinic DBA Qazi Cosmetic Center ("QCC" or "the Practice"), including medical history, medications, allergies, and health conditions, is accurate and complete. You agree to update QCC promptly of any changes prior to each appointment. You assume all risks associated with your failure to disclose accurate, complete, or updated medical information, and you release QCC and its providers from any liability arising from such nondisclosure to the fullest extent permitted by law.

1.2 Minors

For patients under 18 years of age, the parent or legal guardian who books and pays for services agrees to be bound by these Terms and must provide written consent before any service is performed. The parent or guardian is financially responsible for all charges incurred on behalf of the minor patient.

2. Medical Disclaimer & Informed Consent

2.1 No Medical Advice

All content on this Site is for general educational and informational purposes only. It does not constitute medical advice, diagnosis, or treatment. No doctor-patient relationship is created by your use of this Site, viewing of our content, or submission of an inquiry.

2.2 Required Evaluation

All patients must complete an in-person or telehealth consultation and sign a separate Medical Informed Consent before receiving treatment. These Terms are financial and office policies; they are separate from your medical informed consent and any clinical documentation.

2.3 No Outcome Guarantees

Individual results vary based on anatomy, skin type, medical history, compliance with aftercare, and other factors. QCC makes no guarantees of specific outcomes. Before-and-after photographs on our Site represent individual experiences and do not constitute a promise of similar results.

2.4 Treatment Eligibility

All treatments require provider evaluation and approval. Purchasing a treatment or package does not guarantee medical eligibility. If your provider determines that a treatment is not appropriate, safe, or beneficial for you, the service will be deferred or declined. In such cases, your deposit may be applied to an alternative service at the provider's discretion, subject to the modification policies in Section 4.6.

3. Definitions

3.1 Defined Terms

For purposes of these Terms, the following defined terms apply throughout:

  • "Category 1" means Non-Surgical Aesthetic Treatments as described in Section 5.1.
  • "Category 2" means Surgical & Advanced Reconstructive Procedures as described in Section 5.2.
  • "Category 3" means Retail Products, Merchandise & Shipping as described in Section 5.3. Category 3 does not include consultations, office visits, follow-up appointments, or any medical, diagnostic, or provider service.
  • "Category 4" means Ancillary Services & Third-Party Fees as described in Section 5.4. Category 4 does not include consultations, office visits, follow-up appointments, retail products, merchandise, or shipping.
  • "Promotional Credits" means credits issued under our loyalty and promotional program that have no cash value and may only be redeemed for eligible services.
  • "Rewards Points" means points earned under our Rewards Program as described in Section 8.2.
  • "Rewards Program" means the points-earning component of the Loyalty Program described in Section 8.2 and Section 9.
  • "Deposit" means any advance payment required to secure an appointment or service, as more fully described in the applicable Service Category.
  • "Invoice" means the total quoted or actual charges for services, products, or ancillary items.
  • "Business Day" means Monday through Friday, excluding federal holidays observed in California.
  • "Written Notice" means communication submitted via email to contact@qazicenter.com or text message to QCC's designated business line. Written Notice is deemed received when transmitted to the correct email address or phone number. It is the patient's responsibility to use the correct contact information and to retain proof of transmission. If a patient receives a delivery failure notification, the notice is not deemed received, and the patient must use an alternative written channel promptly. Verbal cancellations, voicemail cancellations, or cancellations sent to incorrect contact channels are not valid.

3.2 Liquidated Damages Standard

Where these Terms provide for liquidated damages, those amounts represent a genuine and reasonable pre-estimate of our actual anticipated losses, including reserved provider time, treatment room or facility occupancy, staff allocation, supplies prepared for your appointment, equipment allocation, and the lost opportunity to treat another patient in your reserved slot. They are not a penalty.

4. Universal Booking & Payment Policies

The following policies apply to all patients and all service categories unless expressly modified in a specific Service Category section below.

4.1 Appointment Confirmation

No appointment is confirmed until a deposit has been received and acknowledged in writing by QCC. Verbal confirmations are not valid. It is your responsibility to ensure that QCC has acknowledged receipt of your deposit and confirmed your appointment in writing.

4.2 Cancellation Defined

A "cancellation" includes any request to terminate, postpone, reschedule, or modify an appointment. Rescheduling or modification is treated as a cancellation and new booking. To move your appointment to a new date, you must cancel your existing appointment and make a new booking. Your original deposit will be handled according to the specific cancellation and refund timelines set forth in Section 5, and a new deposit is required for the new appointment.

Please cancel or reschedule by emailing contact@qazicenter.com or texting our business line. Verbal cancellations, voicemail cancellations, cancellations sent to incorrect contact channels, and cancellations submitted via social media are not valid and will not exempt you from applicable liquidated damages. Once you send your written notice to the correct channel, it is effective immediately. Please keep proof of your message so we can help you quickly if any question arises.

4.3 Medical Fitness

Your safety is the reason we review your medical history before every appointment. If your health changes after you book—whether you become pregnant, start a new medication, or develop an illness—please tell us immediately. Because we reserve dedicated time, supplies, and staff specifically for you, our cancellation timeline still applies even when the change is medical. We will always help you reschedule for the earliest safe date, and your deposit may transfer to that new appointment under the modification policies in Section 4.6. It is your obligation to disclose all relevant medical conditions, medications, and changes in health status prior to your appointment.

4.4 Late Arrival & No-Show Matrix

Arriving more than fifteen (15) minutes late may result in rescheduling or cancellation of your appointment, subject to the same liquidated damages as a late cancellation for your service category. A "no-show" results in absolute forfeiture of payment as liquidated damages under Section 3.2 and means explicitly:

  • Failure to arrive at QCC's facility by the scheduled appointment time;
  • Failure to physically check in with QCC staff at the scheduled time;
  • Arrival more than fifteen (15) minutes late where the attending provider determines the appointment cannot be completed safely or properly in the remaining time; or
  • Failure to complete required pre-appointment virtual visits or electronic paperwork submissions by the stated deadline.

A no-show is treated as a cancellation within the applicable late-cancellation tier and incurs the liquidated damages outlined for the applicable service category. For consultations, late arrivals and no-shows are governed by Section 6.3.

4.5 One-Year Completion, Universal Expiration, and Administrative Case Closure

All prepaid services must be completed within one (1) year of the initial deposit or purchase date. If services are not completed within one year, the prepaid agreement terminates, and any remaining prepaid balance is retained as a final administrative case management fee. This fee covers actual administrative expenses including chart maintenance, record retention, compliance documentation, and operational costs associated with holding reserved capacity.

Unused balances, promotional credits, referral incentives, loyalty rewards, or operational account balances are automatically non-refundable and non-transferable after this one-year period, unless explicitly indicated otherwise in writing on your specific treatment proposal or promotional voucher. This administrative case management fee is not a penalty, but reasonable compensation for actual administrative costs incurred in maintaining patient records, scheduling systems, compliance documentation, and reserved capacity. QCC's actual costs in holding reserved capacity and maintaining dormant cases typically meet or exceed the retained balance.

4.6 Modification & Rescheduling Fees

If you modify your treatment plan (including changes to procedures, areas treated, anesthesia plans, or products) or reschedule your appointment, your pricing will update to current rates, which may exceed your original quote. The original quoted price becomes void upon any modification or rescheduling. Provider availability for rescheduled appointments is not guaranteed.

QCC reserves the right to assign a different provider, reschedule to the next available date, or decline the reschedule request entirely, in which case cancellation policies shall apply. Surgical facility availability, anesthesia scheduling, and provider availability are subject to change without notice. If a surgical center cancels a reservation or a provider becomes unavailable, QCC will use commercially reasonable efforts to offer the next available appointment or an alternative provider. QCC is not liable for delays arising from third-party facility cancellations, provider illness, or other operational circumstances beyond its control. QCC is not financially obligated for any charges that may arise from the modification or rescheduling of your treatment plan or appointment.

4.7 QCC-Initiated Cancellation and Rescheduling

If QCC must cancel, delay, or postpone your scheduled treatment or procedure due to unforeseen circumstances beyond our reasonable control—including, but not limited to, provider illness, sudden clinical or family emergencies, sudden operational constraints, or third-party surgical facility closures—our baseline policy is to reschedule the patient's appointment to the earliest available safe and mutually acceptable date.

Because these specific occurrences are entirely outside of our control, QCC is not financially responsible or legally liable for any third-party travel expenses, non-refundable flights, hotel or lodging costs, lost wages, or secondary incidental expenses incurred by the patient as a result of a practice-initiated rescheduling. QCC's regular cancellation penalties remain active for patient-initiated changes, but practice-initiated modifications will never result in a penalty to the patient.

4.8 Proposal & Quote Validity

All proposals and quotes are valid for thirty (30) calendar days from the date of issuance, unless explicitly indicated otherwise in writing on your specific proposal documentation. Prices are locked only if purchased within that window. After thirty (30) days, current market pricing applies regardless of any prior quote.

4.9 Payment Methods

We accept cash, major credit cards, cashier's checks (provided at least forty-eight (48) hours in advance of your treatment reservation), wire transfers, Zelle, and Cherry financing. We do not participate in insurance plans. You are personally and financially responsible for all charges regardless of any anticipated insurance reimbursement or third-party payment. We do not bill insurance, submit claims to insurance, or negotiate with any third-party payer. Any claim for reimbursement is solely your responsibility.

4.10 Refunds

Eligible refunds are issued to the original payment method within thirty (30) days. Cash refunds are issued by check within thirty (30) days and may be picked up at our facility or mailed via certified mail at the patient's expense.

All rendered services, completed appointments, opened or used products, and physical products with removed tags or seals are final sale. Unopened, non-prescription products may be returned within seven (7) days of delivery, subject to the conditions in Section 11.

4.11 Collections and Administrative Cost Recovery

If any payment is not received within forty-five (45) days of the invoice due date, the account may be referred to collections. You expressly authorize QCC to add reasonable administrative and collection costs to any past-due balance referred for collection.

4.11.1 Payment Disputes and Chargebacks

You agree not to initiate a credit card chargeback, payment dispute, or similar reversal of any charge without first contacting QCC in writing and allowing ten (10) Business Days to resolve the matter. This does not limit your rights to dispute unauthorized or fraudulent charges with your issuing bank. You agree to reimburse QCC for actual chargeback fees, bank penalties, and administrative staff costs incurred due to wrongful or frivolous disputes. In the event of a chargeback, QCC may immediately suspend services, terminate Loyalty Program privileges, and refer the account to collections.

4.11.2 Attorney Fees, Collection Costs, and Interest on Past-Due Balances

In the event QCC must engage legal counsel or a collection agency to recover any past-due balance, you agree to pay all reasonable attorney fees, court costs, and collection agency fees in addition to the amounts owed. Past-due balances shall accrue interest at one and one-half percent (1.5%) per month (eighteen percent (18%) per annum) from the date the balance becomes past due until paid in full.

4.12 Good Faith Cooperation

Both QCC and the patient agree to act in good faith in all dealings under these Terms. This includes providing accurate information, honoring confirmed appointments, and communicating changes promptly through the channels specified in these Terms.

4.13 Non-Transferability

Unless expressly authorized in writing by QCC, prepaid services, deposits, and credits are not transferable to another person. They are not transferable between service categories unless expressly stated otherwise in these Terms.

4.14 Provider Discretion

All services are provided at the sole discretion of the attending provider, and you will be evaluated immediately prior to treatment. Treatment eligibility, and the handling of your deposit where a service is deferred or declined, are governed by Section 2.4.

4.15 Right to Decline or Discontinue Services

QCC reserves the right to decline to provide services to any prospective patient, or to discontinue services to any existing patient, at any time and for any lawful reason in its sole medical and professional discretion, including but not limited to: policy violations, safety concerns, staff or provider discomfort, inappropriate behavior, medical contraindications, or operational capacity limitations. If QCC determines that it cannot meet a patient's needs or that the patient relationship is no longer viable, QCC may terminate the patient relationship and provide referrals to appropriate alternative providers. QCC will comply with all applicable laws regarding continuity of care and emergency treatment when discharging a patient from care.

If QCC terminates the patient relationship due to a violation of Section 15 (Patient Conduct), deposits and prepayments shall be forfeited as liquidated damages in accordance with Section 15.1.

4.16 Pre-Procedure Vitals and Emergency Protocol

Your vitals, including blood pressure, may be checked at any point during your visit to confirm that you are medically prepared and safe to proceed. If your vitals indicate that you are not medically fit to proceed, we may need to delay or cancel your treatment. Depending on what we observe, we may send you to urgent medical care or contact emergency services on your behalf. These decisions are always made with your wellbeing as our only priority.

You are responsible for all costs associated with any outside medical services, including urgent care, emergency room visits, ambulance transport, and related fees. This remains true even if you traveled to our office specifically for your appointment. QCC does not assume responsibility for travel expenses, accommodation costs, lost time, or any other costs that arise when we determine you are not medically fit to proceed. Our regular scheduling and cancellation policies apply in all cases. We may consider exceptions or special accommodations, including priority rebooking, but we are under no obligation to offer them outside of our standard policies.

4.17 Text Messaging and Communications Consent

By providing your mobile phone number to QCC, you consent to receive text messages from us for appointment confirmations, reminders, and operational communications related to your care. You may also opt in to receive marketing messages about services, promotions, and events. Message and data rates may apply depending on your carrier. You may opt out of marketing texts at any time by replying STOP. For help, reply HELP. Opting out of operational texts may limit our ability to confirm or remind you about appointments.

Your text messaging opt-in data and consent are not shared with any third parties. We comply with the Telephone Consumer Protection Act (TCPA) by maintaining records of your consent, including opt-out instructions in every message, and honoring opt-out requests promptly. By opting in, you warrant that you are the account holder or authorized user of the phone number provided and that you are at least 18 years of age. You agree to notify QCC immediately if you change your mobile telephone number by emailing contact@qazicenter.com.

4.18 Email Communications and Marketing Consent

By providing your email address to QCC through any form, quiz, inquiry, or promotional sign-up on our Site, you consent to receive email communications from us. These communications fall into two categories:

  • Operational emails are necessary for your care and may include appointment confirmations, pre-visit instructions, post-treatment follow-up, and billing notices. You may not opt out of operational emails while you have an active appointment or outstanding balance, as these communications are part of our standard care protocol.
  • Marketing emails include information about promotions, new services, events, and educational content. You may opt out of marketing emails at any time by clicking the unsubscribe link at the bottom of any marketing email or by emailing contact@qazicenter.com. We will process your opt-out request within ten (10) Business Days. Opting out of marketing emails does not remove you from operational email communications.

You represent that the email address you provide is accurate and that you have the authority to receive communications at that address. It is your responsibility to update QCC promptly if your email address changes.

5. Service Categories

5.1 Category 1: Non-Surgical Aesthetic Treatments

5.1.1 Scope

Category 1 includes the following and similar non-surgical services: Erbium Laser, Fractional Laser, Filler Dissolving, All Filler Injectables, HairFX, Hand Volume Restoration, Laser Acne, Laser Anti-Aging, Laser Hair Removal, Laser Pigmentation, Microgold, Minitox, Xeomin, Dysport, Morpheus8, Pico Laser, PRP, Radiesse, Tattoo Removal, and Vein Removal.

5.1.2 Deposit & Payment

A deposit of ten percent (10%) of the total invoice or one hundred fifty dollars ($150), whichever is greater, is required to secure every Category 1 appointment. Your appointment is not confirmed until the deposit has been received and acknowledged in writing by QCC. Your full invoice must be paid before any service is performed; if a balance remains, your service will not proceed.

5.1.3 Cancellation Window & Liquidated Damages

For Category 1 services, you must provide written cancellation notice at least forty-eight (48) hours before your scheduled appointment time. If you cancel more than forty-eight (48) hours in advance, your deposit will be refunded to your original payment method within thirty (30) days.

Cancellations made within forty-eight (48) hours of the appointment, no-shows, or arrivals more than fifteen (15) minutes late result in total forfeiture of your deposit as liquidated damages. Liquidated damages under this Section are calculated and enforced in accordance with the standard defined in Section 3.2. Rescheduling or modification is treated as a cancellation and new booking under Section 4.2.

5.1.4 Prepaid Laser Packages

Prepaid laser packages require adherence to scheduling windows agreed upon at purchase. Failure to arrive on time for a prepaid laser session or failure to provide proper notice of cancellation within the forty-eight (48) hour window will result in forfeiture of that session from your package as liquidated damages. Liquidated damages under this Section are calculated and enforced in accordance with the standard defined in Section 3.2.

5.1.5 Tattoo Removal Prepaid Package

Tattoo Removal treatments are offered at a discounted rate when purchased as a prepaid package of three (3) or more sessions. The package must be paid in full at the time of reservation. If you request a refund for any unused treatments in your package, the treatments you have already received will be recalculated and charged at the full current non-discounted price per session. The remaining balance, if any, will be refunded to your original payment method within thirty (30) days in accordance with Section 4.10.

Cancellations made more than forty-eight (48) hours prior to a scheduled package session are eligible for refund of the unused portion under the terms above. Cancellations made within forty-eight (48) hours, no-shows, or arrivals more than fifteen (15) minutes late result in forfeiture of that scheduled session as liquidated damages per Section 5.1.3 and Section 5.1.4. If you are no longer medically fit to continue Tattoo Removal treatments, any unused sessions may be transferred to another Category 1 service at your provider's discretion. All Tattoo Removal package sessions must be completed within one (1) year of purchase per Section 4.5.

5.1.6 Peel and Pico Laser Prepaid Package

The Peel and Pico Laser Package combines one (1) peel treatment with a set of Pico Laser treatments at a discounted rate for both services when purchased together as a package. The package must be paid in full at the time of reservation. If you request a refund for any unused services in your package, the peel and laser treatments you have already received will each be charged at their full current non-discounted list price. The remaining balance, if any, will be refunded to your original payment method within thirty (30) days in accordance with Section 4.10.

Cancellations made more than forty-eight (48) hours prior to a scheduled package session are eligible for refund of the unused portion under the terms above. Cancellations made within forty-eight (48) hours, no-shows, or arrivals more than fifteen (15) minutes late result in forfeiture of that scheduled session as liquidated damages per Section 5.1.3 and Section 5.1.4. If you are no longer medically fit to continue the treatments in your package, any unused sessions may be transferred to another Category 1 service at your provider's discretion. All package services must be completed within one (1) year of purchase per Section 4.5.

5.1.7 Category 1 Credit Lock

If a patient does not proceed with a purchased Category 1 treatment for any reason, the amount paid becomes a Category 1-Locked Credit. This credit can only be used for future Category 1 services. It cannot be used for Category 2 services, Category 3 items, Category 4 services, deposits, or products. It does not transfer to another person and expires after one (1) year per Section 4.5.

5.2 Category 2: Surgical & Advanced Reconstructive Procedures

5.2.1 Scope

Category 2 includes the following and similar surgical or advanced reconstructive services: Acne Scar Treatment, Arm Lift, Aveli, Bellafill, Liposuction, Breast Augmentation, Breast Implant Replacement, Breast Lift, Breast Reconstruction, Breast Reduction, Brow Lift, Buccal Fat Removal, Buttock Lift, Chin Liposuction, CO2 Laser, Dermabrasion, Ear Pinning, Erbium Laser (surgical application), Elliptical Excision, Excision, Upper Blepharoplasty, Lower Blepharoplasty, Eyelid Surgery, Facelift, FaceTite, Facial Implants, Fat Transfer, Gynecomastia, Labiaplasty, Lip Lift, Lower Body Lift, Microlipo, Neck Lift, Neck Liposuction, Nipple Reconstruction, Phenol Peel, Renuvion, Revision Plastic Surgery, Rhinoplasty, Scar Revision, Silicone Filler Removal, Subcision, TCA Cross, Thigh Lift, Tummy Tuck, General Surgery, and Otoplasty.

5.2.2 Deposit

A reservation deposit of one thousand three hundred dollars ($1,300) or ten percent (10%) of the total invoice, whichever is greater, is required to schedule any Category 2 procedure. This deposit is applied toward your final balance and is non-refundable except as provided explicitly in Section 5.2.5. It compensates QCC for administrative case management, scheduling coordination, and reserved surgical capacity.

5.2.3 Full Payment Deadline

Full payment of the invoice is due by 5:00 PM Pacific Time on the fourteenth (14th) day prior to the scheduled procedure date. If payment is not received by that deadline, the procedure is automatically cancelled. The deposit and any amounts paid to date are retained as liquidated damages for scheduling and administrative costs. The unpaid balance of the invoice does not become due. You may rebook the procedure within one (1) year by paying current pricing and a new deposit.

5.2.4 Cancellation More Than 14 Days Prior

If you cancel your appointment more than fourteen (14) days before the scheduled appointment date, your deposit may be transferred to another Category 2 service performed at QCC within one (1) year from your signed proposal. The transferred deposit remains subject to the same Category 2 cancellation policies. No cash refund will be issued.

5.2.5 Cancellation 14 to 7 Days Prior: Liquidated Damages

For cancellations made within fourteen (14) to seven (7) days prior to the procedure date, your deposit is retained as liquidated damages. An additional amount is also retained as liquidated damages such that the total amount retained equals fifty percent (50%) of the total invoice or $1,300 (whichever is greater). Liquidated damages under this Section are calculated and enforced in accordance with the standard defined in Section 3.2.

Amounts paid above the total retained amount may be refunded to the original payment method within thirty (30) days. If you have paid less than the total liquidated damages amount, the unpaid balance shall become immediately due and payable.

5.2.6 Cancellation Within 7 Days: Liquidated Damages

Cancellations made within seven (7) days of the procedure date result in your deposit being retained as liquidated damages. You agree that the remaining unpaid balance of the invoice shall also become immediately due and payable as liquidated damages for our actual anticipated losses. Liquidated damages under this Section are calculated and enforced in accordance with the standard defined in Section 3.2. No refunds or transfers are available.

5.2.6.1 Express Acknowledgment of Deposit and Liquidated Damages Nature

By scheduling a Category 2 procedure and paying your deposit, you expressly acknowledge and agree that: (a) your deposit is a non-refundable fee fully earned upon receipt for the administrative, scheduling, and product-allocation functions listed in Section 5.2.2; (b) the amounts retained in Sections 5.2.5 and 5.2.6 are liquidated damages for actual anticipated losses; (c) you have had the opportunity to ask questions about these terms and understand their financial consequences; and (d) you understand that if you cancel within seven (7) days of the procedure date, the full invoice amount becomes due and payable as liquidated damages.

5.2.7 One-Year Expiration of Deposit Credit

There is no option for cash refund of a Category 2 deposit. If the total amount paid exceeds the liquidated damages cap set forth in Section 5.2.5, only the excess may be refunded (subject to Section 4.10). Deposits may not be applied toward any service after one (1) year if the procedure is not performed. Deposits may not be transferred to any other person.

5.2.8 Excluded Costs

Procedure fees do not include lab tests, preoperative clearances, primary care physician visits, medications, compression garments, or other ancillary items, which are the patient's sole financial responsibility.

5.2.9 Cancellations for Any Reason

We understand that life is unpredictable and that your health must always come first. Our cancellation structure is the same for every patient because the costs of a released surgical slot—staff time, facility reservation, and lost opportunity to care for someone else—are the same regardless of the reason. This consistency allows us to be fair with everyone in our practice and to continue investing in the advanced care you expect.

5.3 Category 3: Retail Products, Merchandise & Shipping

5.3.1 Scope & Payment

Category 3 includes only retail products and logistics services: Skincare Products, Merchandise, and Shipping Fees. Category 3 does not include consultations, office visits, follow-up appointments, or any medical, diagnostic, or provider service. Category 3 items must be paid in full at the time of purchase. No deposit is required for standard product orders. Orders are processed upon confirmed payment.

5.3.2 Non-Transferable

Category 3 products are non-transferable between persons unless expressly authorized in writing by QCC. Rewards Points may not be earned or redeemed for Category 3 items. Loyalty Program benefits may not be applied to Category 3 items. Valid, unexpired gift cards may be used for skincare products and merchandise at QCC's discretion.

5.3.3 Returns

All product returns and exchanges are governed by Section 11 (Shipping & Returns). Unopened, non-prescription items may be returned within seven (7) days of delivery. Opened, used, or tag-removed products are final sale. Prescription skincare products, compounded medications, and medical devices may not be returned under any circumstances except as required by law. Customer pays all return shipping costs.

5.4 Category 4: Ancillary Services & Third-Party Fees

5.4.1 Scope & Pass-Through Terms

Category 4 includes only ancillary medical services and third-party fees: Anesthesia Fees, Biopsy / Pathology, Facility Fees, Labs, Imaging, and EKG. Category 4 does not include consultations, office visits, follow-up appointments, retail products, merchandise, or shipping. These are pass-through costs that QCC incurs immediately upon scheduling with third-party providers. Once ordered or scheduled, these costs cannot be recovered by QCC from the third-party provider, regardless of whether the underlying procedure or appointment is subsequently modified, cancelled, or rescheduled.

5.4.2 Payment & Non-Refundability

Category 4 fees are typically included in the total invoice for a procedure or service and must be paid in full before the procedure or service is performed. When scheduled separately from a procedure, payment is required at the time of scheduling.

Category 4 fees are strictly non-refundable and non-transferable. Because these are pass-through costs to third-party medical providers, laboratories, surgical facilities, and anesthesia providers, QCC cannot recover the funds once scheduled or performed. This policy applies regardless of the reason for cancellation, modification, or rescheduling, including but not limited to health changes, pregnancy, medical non-clearance, financial changes, or personal scheduling conflicts. Rewards Points cannot be earned or redeemed for Category 4 services or fees. Loyalty Program benefits and gift cards may not be used for Category 4 services or fees. Prepaid Category 4 ancillary services are subject to the one-year completion policy in Section 4.5.

5.5 Accure Laser Treatment

5.5.1 Package Terms

Full payment is required to reserve your appointment. Cancellations made more than forty-eight (48) hours prior are eligible for a full refund to your original payment method within thirty (30) days. Cancellations made within forty-eight (48) hours, no-shows, or arrivals more than fifteen (15) minutes late result in forfeiture of that reserved treatment. For package treatments, this forfeiture applies to the individual reserved session. Once a treatment is completed, no refund is available for that session. All package treatments must be completed within 1 year of purchase.

5.5.2 Accure Laser Package Terms

Accure Laser treatment is sold as a package of three (3) paid sessions. When you purchase the complete package in a single transaction, you are automatically enrolled in the Accure Acne Warranty Program described in Section 10.3. Your package includes one complimentary fourth session at no additional charge if your provider determines it is clinically appropriate, along with discounted pricing on any additional maintenance sessions you may need in the future. The complimentary session has no cash value and may not be redeemed for cash or any cash equivalent. Full payment is required to reserve your appointment.

5.5.3 Single Accure Treatment Terms

Single Accure Laser treatments are subject to the payment, cancellation, forfeiture, refund, and completion rules in Section 5.5.1, with the following specific terms: the full price of the single treatment serves as the deposit and is due at the time of purchase to reserve your appointment. QCC reserves the right to modify, suspend, or terminate Accure Laser package terms, pricing, pay-as-you-go policies, and warranty eligibility at any time without notice.

5.6 Ultrasound-Guided Filler Assessment

A two hundred dollar ($200) fee applies to all Ultrasound-Guided Filler Assessments. This fee is due at the time of reservation to secure your appointment. It is a separate diagnostic fee and may not be applied as a deposit toward, or credited against, any treatment service. It does not transfer to another person or service category.

5.7 Outside-Location Treatments and Special Events

For treatments held outside of our Newport Beach office, your full proposal amount is due when you reserve your appointment. This allows us to secure your time, coordinate resources, and prepare the specific equipment and supplies required for your visit.

You may cancel within twenty-four (24) hours of booking for a complete refund to your original payment method. If you cancel after that refundable window but more than fourteen (14) days before your appointment, we retain fifty percent (50%) as liquidated damages and refund the remaining fifty percent (50%). If you cancel within fourteen (14) days of your appointment, your full payment is retained as liquidated damages to cover the resources, equipment, supplies, and coordination prepared specifically for your reservation.

Once your proposal is accepted, you may modify your treatment plan only if your new selections can be performed with the limited equipment and supplies available at our outside location. We cannot guarantee treatments beyond your original proposal. If you remove services or products after the twenty-four (24) hour refundable window closes, you remain responsible for your full original invoice total, since the equipment and clinical time are reserved as a complete plan.

5.7.1 QCC-Initiated Outside Cancellation

Practice-initiated cancellations or operational delays regarding special events or outside locations are governed entirely by the universal guidelines and rescheduling mandates set forth in Section 4.7.

6. Consultations

This Section governs all consultations and provider-evaluation visits, including but not limited to: initial consultations, subsequent consultations, office visits, and follow-up appointments. Consultations are professional services for provider time and clinical evaluation. They are not part of any Service Category and are governed exclusively by the terms in this Section.

6.1 Payment and Reservation

Your consultation fee is due in full at the time of booking. No consultation is scheduled, held, or guaranteed without confirmed payment. Consultation fees vary by provider and service type and are subject to change without notice.

6.2 Application Toward Treatment

Your consultation fee may be applied as a discount to eligible services performed during your visit. It may also be applied as a discount toward a future eligible service if reserved on the same day as your consultation, at QCC's discretion.

6.3 Cancellation, No-Show, and Liquidated Damages

If you cancel with more than forty-eight (48) hours' written notice, your fee may be rescheduled or refunded to your original payment method within thirty (30) days. Cancellations made within forty-eight (48) hours of your scheduled consultation; no-shows; arrivals more than fifteen (15) minutes late; or failure to submit your records on time will result in forfeiture of your fee and reservation as liquidated damages.

Liquidated damages under this Section are calculated and enforced in accordance with the standard defined in Section 3.2. If you need to change your appointment, please provide written notice as early as possible so we can offer your time to another patient.

6.4 Exclusions and Non-Transferability

Your consultation fee and reservation are assigned to you only. They may not be transferred to another person, applied toward products, or used for skincare purchases. They are also non-transferable to a different service category. Once a consultation has been completed, no refund is available for any reason. Subsequent consultations require new payment, even for existing patients; each consultation is a discrete service with its own fee.

7. Telehealth & Virtual Visits

7.1 Scope

QCC offers virtual appointments and telehealth visits conducted via HIPAA-compliant secure video conferencing. These visits are clinical evaluations conducted remotely and are subject to the same professional standards as in-person consultations.

7.2 Pre-Visit Requirements

Patients must submit all requested photos and complete all required medical history forms at least forty-eight (48) hours prior to the scheduled virtual visit. These materials are required for the provider to prepare for the appointment and to conduct a meaningful clinical evaluation.

7.3 Late or Incomplete Submissions

If requested photos or medical history forms are not submitted by the forty-eight (48) hour deadline, the virtual appointment will be canceled and treated as a no-show. Liquidated damages applicable to the service category or consultation type of the underlying appointment shall apply.

7.4 Technical Support Presence

A member of QCC's technical support staff may be present during the video conference to assist with connectivity, audio, or video quality. Technical support staff are bound by the same HIPAA confidentiality obligations as clinical staff.

7.5 Patient Environment

Patients must join the video conference from a quiet, well-lit, private room where the consultation cannot be overheard or interrupted. Patients may not participate in a telehealth visit while operating a vehicle or machinery. The patient is responsible for ensuring adequate internet connectivity, device functionality, and camera and audio quality.

7.6 Platform and Security

All telehealth visits are conducted through QCC's HIPAA-compliant secure video conferencing platform. Patients may not record, screenshot, or redistribute any portion of the video conference without express written permission from QCC. Personal note-taking during the session is permitted provided no audio or video is captured.

7.7 State Licensing and Eligibility

Telehealth services are provided in accordance with applicable state licensing laws. QCC reserves the right to determine whether a telehealth visit is clinically appropriate for a patient's needs and may require an in-person evaluation in lieu of or in addition to a virtual visit. Telehealth visit cancellations are governed by the cancellation policies of the underlying service category or consultation type.

8. Promotional Credits & Rewards Program

8.1 Gift Cards Framework (California Compliant)

Gift Cards No Longer Offered; Existing Gift Cards: QCC previously sold gift cards and gift certificates. As of April 2026, we no longer offer, sell, or issue new gift cards of any kind. Existing gift cards remain valid under the terms in effect at the time of purchase and in accordance with applicable California law (Cal. Civ. Code § 1749.5). Specifically, the base cash value paid by the original purchaser does not expire. Any promotional bonus amount given in excess of the purchase price expires exactly one (1) year from the original date of purchase.

Gift cards may only be allocated to one patient account and used by that account holder. A gift card may be transferred to another person before its first use. After the first use or profile assignment, the gift card becomes non-transferable and is permanently locked to that specific patient account. Gift cards are non-refundable after purchase, cannot be redeemed for cash or cash equivalents, and cannot be combined with other separate rewards, promotions, or discounts.

Existing gift cards may be redeemed explicitly for eligible Category 1 and Category 2 services, or for skincare products and merchandise within Category 3, and for consultations at QCC's discretion. They may not be used for Category 4 ancillary services or fees. QCC is not responsible for lost, stolen, or unauthorized use of gift cards.

8.2 Rewards Points

8.2.1 Earning Points

Patients earn one (1) Rewards Point per one dollar ($1) spent on eligible services. Points are credited to the patient's account only after the service has been completed, not when the invoice is created or payment is made.

The following do not earn Rewards Points: taxes; Promotional Credit purchases; Category 3 items; Category 4 services; Qazi Academy services; and any other products or services designated as excluded by QCC from time to time. Points redeem at a rate of twenty (20) points = one dollar ($1) toward eligible services (a 5% return on eligible spending).

8.2.2 Expiration and Forfeiture

Points expire twelve (12) months from the date the service was completed and the points were credited to the account. The expiration date does not reset, extend, or change due to appointment rescheduling, account activity, or subsequent purchases. Unused points are automatically forfeited upon expiration. Points have no cash value, are non-refundable, are not your property, and are non-transferable.

Selling, bartering, or unauthorized transferring of points results in immediate forfeiture of all points, suspension of rewards privileges, and account review. Points and rewards will be redacted immediately after a refund of fees has been issued to an account holder. Post-transaction point adjustments are not permitted, except in the case of documented system errors. There is no cap on how many Rewards Points a patient may accumulate. Employees and family members are ineligible for point accumulation or redemption on purchases made through employee or family discounts. Points are awarded only for services rendered to the account holder and cannot be earned on behalf of another person.

8.3 Referral Program

8.3.1 Existing Patient Reward

Existing patients (defined as a patient who has paid an invoice for services) receive a one hundred dollar ($100) credit for each new patient referred who purchases five hundred dollars ($500) or more in qualifying services. The existing patient will receive the reward only after the referred patient's service has been completed.

8.3.2 Referred Patient Reward

The referred patient receives a one hundred dollar ($100) credit toward their first purchase of services over five hundred dollars ($500). Each new patient may claim only one (1) referrer. There is no limit to the number of referrals an existing patient may provide.

8.3.3 Qualifying Purchases

Qualifying service purchases include treatments and services only and do not include Category 3 items or Category 4 services. Referral rewards credits are not applicable for redemption on Category 3 items or Category 4 services. They may not be used as a deposit, toward any deposit requirement, or as payment for products, merchandise, Category 4 ancillary fees, consultations, or shipping. They are non-transferable and valid for one (1) year from the date of eligibility.

8.4 Birthday Rewards

8.4.1 Birthday Reward Amount

Patients enrolled in the QCC Loyalty Program receive a one hundred dollar ($100) Birthday Reward.

8.4.2 Birthday Month Use Only

Birthday Rewards must be used for services scheduled and purchased in the birthday month. Birthday Rewards cannot be applied to any past invoices, existing invoices, or future invoices that fall outside of the birthday month.

8.4.3 Nurse or Physician Associate Only

Birthday Rewards may only be used for services performed by a Nurse or Physician Associate. They may not be applied to services performed by other providers (including doctors).

8.4.4 New Scheduled Services Only

Birthday Rewards must be used on a new service scheduled during the birthday month. They may not be applied to existing appointments, rescheduled appointments, prior balances, or outstanding invoices.

8.4.5 Not Applicable to Deposits

Birthday Rewards may not be used as a deposit, toward any deposit requirement, or as payment for Category 3 items, Category 4 services, or merchandise.

8.4.6 Eligible Services

Birthday Rewards may only be applied to eligible Category 1 services and qualifying prepaid packages. They may not be applied to Category 2 services, Category 3 items, Category 4 services, Qazi Academy services, skincare products, merchandise, consultations, or any service designated as excluded by QCC.

8.4.7 Minimum Purchase Requirement

A minimum purchase of five hundred dollars ($500) in eligible services is required to redeem Birthday Rewards. Birthday Rewards are non-transferable and have no cash value.

8.5 Multiplicative Combination and Redemption Rules

Credits and rewards from multiple benefits programs may be combined, provided the minimum purchase requirements for each individual benefit are met concurrently.

Stacked Spend Multiplier Standard: The total invoice must equal or exceed the sum of the individual minimums for all applied benefits. For every individual $100 reward, promotional credit, or referral incentive applied to a single checkout profile transaction, the invoice must reflect an additional, independent five hundred dollar ($500) minimum spend requirement in qualifying services. For example, stacking a $100 birthday reward and a $100 referral reward requires a strict minimum invoice spend of $1,000 in qualifying services. If the combined, cumulative minimums are not met, multiple credits cannot be utilized in that particular transaction.

Once used, credits and rewards cannot be refunded, reapplied, or returned to the patient profile. Rewards are not applicable for redemption on Qazi Academy services. QCC reserves the right to change eligibility terms, earning rates, and redemption rules at any time. Misuse or fraud leads to immediate suspension, account termination, and forfeiture of all points and credits.

9. Loyalty Program

9.1 Overview

QCC does not offer paid membership tiers. Every patient who completes and pays for an eligible service is automatically enrolled in the QCC Loyalty Program at no additional cost. The Loyalty Program is the umbrella for all patient benefits, including the Rewards Program, Birthday Rewards, and Referral Rewards. There are no tier levels, upgrade options, or annual fees. Your benefits begin automatically with your first eligible service and continue as long as you remain active.

9.2 Eligibility

The Loyalty Program is available to individuals aged 18 and over. Businesses, clubs, and organizations are ineligible. Upon receiving any service at QCC, patients are automatically enrolled in the Loyalty Program. Enrollment is automatic and free of charge. Loyalty Program benefits are non-transferable. Benefits are exclusive to the registered patient. Unauthorized sharing of benefits will result in immediate termination of Loyalty Program privileges.

9.3 Benefits

Loyalty Program benefits include: (i) Rewards Program: Earn 1 point per $1 spent on eligible services, credited after service completion, redeemable at 20 points per $1 (a 5% return). (ii) Birthday Rewards: $100 off eligible Category 1 services and qualifying prepaid packages during your birthday month, subject to Section 8.4. (iii) Referral Rewards: $100 credit for referring new patients who complete qualifying purchases, subject to Section 8.3.

9.4 Duration and Termination

Loyalty Program benefits continue as long as the patient remains active. If no services are received for twenty-four (24) months, Loyalty Program benefits may be suspended. Points expire per Section 8.2.2. Abuse of Loyalty Program privileges may result in immediate termination without notice.

"Abuse" includes, but is not limited to: (i) two (2) or more late cancellations or no-shows within any ninety (90) day period; (ii) violation of any provision of Section 15 (Patient Conduct); (iii) initiating a chargeback or payment dispute in violation of Section 4.11.1; (iv) misuse or unauthorized sharing of Loyalty Program benefits; or (v) any other conduct that, in QCC's reasonable judgment, undermines the integrity of the program. QCC reserves the right to modify or discontinue Loyalty Program benefits, services, or earning rates without notice. All treatments purchased must be serviced within one (1) year of purchase, consistent with the policy in Section 4.5.

10. QCC Warranty Program

10.1 Overview

The QCC Warranty Program provides eligible patients with access to discounted follow-up and maintenance services at fifty-five percent (55%) off the then-current list price. The Warranty Program consists of three distinct sub-programs: the QCC Acne Scar Warranty Program, the Accure Acne Warranty Program, and the QCC Treatment Package Warranty Program. Each sub-program has its own eligibility requirements and qualifying services, as described below.

All warranty program benefits are valid for five (5) years from the date of enrollment. The enrollment date is the date of the paid invoice. Warranty enrollment is available only for qualifying packages and services as specified in each sub-program below. Not all packages or treatments include warranty program benefits. All warranty services are chargeable at the discounted rate; the Warranty Program does not imply complimentary or free future services except for the complimentary fourth session under the Accure Acne Warranty Program.

10.2 QCC Acne Scar Warranty Program

10.2.1 Eligibility

To qualify for the QCC Acne Scar Warranty Program, a patient must purchase all treatments and services specified in the original acne scar treatment proposal in a single transaction. Any modification, omission, deferral, or change to the proposed services at any time, including on the day of treatment, disqualifies the patient from warranty benefits. If you proceed with the complete proposal as quoted, you qualify for the program. If you change your mind and alter the services, add services, remove services, or substitute treatments at any point, you are no longer eligible for the warranty, regardless of how much of the original proposal was completed.

10.2.2 Qualifying Services

Qualifying services for the Acne Scar Warranty Program include only those services that were part of the patient's original purchased acne scar treatment proposal. These may include, where specified in the original proposal: Deep Tissue CO2, Fractionated Resurfacing Laser, TCA Cross, Subcision, Deep Subcision, Combination Laser Treatment, and Bellafill. Split or segmented purchases of any qualifying package will not qualify for warranty benefits.

10.2.3 Discounted Services

Under the Acne Scar Warranty Program, patients receive a fifty-five percent (55%) discount off the then-current list price for additional or follow-up sessions of the same services that were included in their original proposal. A patient may not receive a discounted service that was not part of the original purchased proposal. For example, if Subcision was not included in the original proposal, the patient may not receive a fifty-five percent (55%) discount on Subcision under this program.

10.3 Accure Acne Warranty Program

10.3.1 Eligibility

To qualify for the Accure Acne Warranty Program, a patient must purchase an Accure Laser package of 3 treatments in a single transaction. Full payment is required to reserve your appointment and automatically enrolls you in the Accure Acne Warranty Program. Split or segmented purchases do not qualify.

10.3.2 Complimentary Fourth Session and Discounted Services

The Accure Acne Warranty Program includes your complimentary fourth session, provided at no additional charge as part of your package benefits, if your provider deems you fit and determines that an additional session is clinically appropriate. This complimentary session has no cash value and may not be redeemed for cash or any cash equivalent. Beyond the complimentary session, patients receive a fifty-five percent (55%) discount off the then-current list price for additional Accure Laser treatments.

10.4 QCC Treatment Package Warranty Program

10.4.1 Eligibility

To qualify for the QCC Treatment Package Warranty Program, a patient must purchase the entirety of one of the following qualifying packages in a single transaction: Pico Laser minimum package of 6, Hair PRP minimum package of 3, or FaceTite package of 1. Split or segmented purchases do not qualify. The patient must also complete all sessions within the purchased package without modification to remain eligible for warranty benefits.

10.4.2 Qualifying Services

Qualifying services for the Treatment Package Warranty Program are the specific treatments included within the purchased qualifying package. Each package has its own service menu and session count. The patient must complete all purchased sessions within the package to maintain eligibility for discounted follow-up services.

10.4.3 Discounted Services

Under the Treatment Package Warranty Program, patients receive a fifty-five percent (55%) discount off the then-current list price for additional or follow-up sessions of the same services that were included in their original qualifying package.

10.5 Shared Warranty Terms

Patients must comply with all pre-procedure instructions, home care protocols, and follow-up appointments. Non-compliance may result in disqualification at the provider's discretion. All warranty services are subject to provider evaluation and approval. QCC reserves the right to remove any patient from any sub-program of the Warranty Program with or without cause, including for non-compliance, abuse of terms, inappropriate behavior, or failure to meet eligibility criteria. QCC reserves the right to modify, suspend, or terminate any or all sub-programs of the Warranty Program at any time without notice.

11. Shipping & Returns

11.1 Shipping Scope

Products are shipped within the United States unless otherwise stated. QCC is not liable for carrier delays, theft, weather events, customs issues, or other delivery disruptions outside our control. The receiver is responsible for all taxes, duties, import fees, customs charges, or other governmental assessments associated with delivery.

11.2 Final Sale

All product sales are final once opened, used, or if seals or tags are removed. Unopened, non-prescription items may be returned within seven (7) days of delivery. To initiate a return, contact QCC for authorization. Returns without prior authorization will not be accepted. Customer pays all return shipping costs. Prescription skincare products, compounded medications, and medical devices may not be returned under any circumstances except as required by law.

12.1 Ownership

All content on this Site, including text, images, photographs, videos, logos, graphics, software, and media of any kind, is the exclusive property of Qazi Cosmetic Center. Anti-AI Training Data Protections: QCC explicitly guarantees that we do not sell, license, lease, feed, or share identifiable or de-identified patient data, intake charts, or treatment media with external artificial intelligence platforms, third-party text-generation engines, commercial machine learning models, data brokers, or external analytics providers.

14.4 Operations and Administration Only

QCC will not share your personal information or protected health information with any third party except as necessary for: (i) treatment, payment, and health care operations as permitted under HIPAA; (ii) compliance with legal obligations, court orders, or regulatory requirements; (iii) coordination with your other health care providers with your authorization; (iv) internal administrative functions such as billing, appointment scheduling, and quality assurance; or (v) business sale, merger, acquisition, or similar transaction where data transfer is required, subject to confidentiality protections. QCC does not share or sell data for marketing, advertising, or commercial purposes outside of QCC's own promotional activities. QCC complies with all federal and state privacy rules regarding HIPAA protection.

14.5 Office Monitoring and Call Recording

For patient safety, clinical quality assurance, staff security, and operational training purposes, QCC records all telephone calls to and from our designated business lines and maintains video monitoring in common areas of our facility, including reception, waiting areas, and hallways. Recording devices are not placed in treatment rooms, restrooms, or private changing areas. By calling QCC or entering our facility, you consent to these recordings.

Call recordings and video footage are stored securely, are not sold or shared with third parties for marketing purposes, and are retained in accordance with applicable law and QCC's internal retention policies. If you have questions about our recording practices, contact contact@qazicenter.com.

14.6 Website Forms and Pre-Patient Data

Information you submit through contact forms, quizzes, promotional sign-ups, or other non-clinical inquiries on our Site is collected and processed under our Privacy Policy. This information is not protected health information unless and until you become a patient and clinical records are created. We may use your contact information to respond to your inquiry, send educational materials, and deliver marketing communications about our services. You may request deletion of your pre-patient contact data at any time by emailing contact@qazicenter.com.

14.7 Data Security

QCC implements reasonable administrative, technical, and physical safeguards to protect your information. However, no system is completely secure. You acknowledge that QCC cannot guarantee absolute security of data transmitted to or stored by QCC. In the unlikely event of a data breach affecting your personal information, QCC will notify you in accordance with applicable law.

15. Patient Conduct & Safety

15.1 Our Commitment to a Safe, Respectful Environment

Every person who enters our facility deserves to feel safe, respected, and at ease. We ask that all patients and visitors help us protect this environment by treating our staff, providers, and fellow patients with courtesy and consideration.

The following parameters are strictly enforced:

  • Weapons: Firearms, knives, mace, pepper spray, and all weapons are strictly prohibited on QCC premises regardless of any concealed carry permits or licenses.
  • Harassment: Sexual harassment, unwanted advances, or inappropriate physical contact toward staff, providers, or other patients are prohibited.
  • Threats and Violence: Verbal or physical threats, intimidation, aggressive behavior, or any act of violence are strictly prohibited.
  • Respectful Communication: Abusive, demeaning, profane, discriminatory, or disruptive language or behavior is not permitted.
  • Property: Theft, attempted theft, or intentional damage to QCC property, retail products, or equipment will result in immediate expulsion and reporting to law enforcement.

15.2 Consequences of Misconduct & Recording Prohibitions

To protect patient privacy and staff dignity, unauthorized audio or video recording of staff, providers, or other patients within QCC's facility or during telehealth visits is prohibited. Personal note-taking is permitted.

Violation of this policy results in immediate termination of the patient relationship, cancellation of all future appointments, forfeiture of deposits and prepayments as liquidated damages, permanent ban from the practice, and potential legal action. QCC reserves all legal rights. Violations of the recording prohibition may result in immediate termination of the patient relationship and referral to law enforcement.

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California.

16.2 BINDING ARBITRATION AND CLASS ACTION WAIVER

ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THE SITE, YOUR PURCHASE OF SERVICES OR PRODUCTS, OR YOUR RELATIONSHIP WITH QCC SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION IN ORANGE COUNTY, CALIFORNIA, UNDER THE THEN-APPLICABLE AMERICAN ARBITRATION ASSOCIATION ("AAA") CONSUMER ARBITRATION RULES. BY ACCEPTING THESE TERMS, YOU WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, COLLECTIVE ACTIONS, OR OTHER REPRESENTATIVE PROCEEDINGS. JUDGMENT ON THE ARBITRATION AWARD MAY BE ENTERED IN ANY COURT HAVING JURISDICTION. THIS ARBITRATION PROVISION DOES NOT APPLY TO CLAIMS FOR MEDICAL NEGLIGENCE OR PATIENT INJURY, WHICH ARE EXCLUDED UNDER SECTION 16.3.

16.3 Medical Negligence Claims

Claims involving medical negligence or patient injury are excluded from arbitration and are litigated separately.

16.4 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

16.5 Survival

All provisions that by their nature should survive termination of these Terms (including payment obligations, dispute resolution, confidentiality, and limitations of liability) shall survive.

16.6 Arbitration Opt-Out

Within thirty (30) days of first accepting these Terms, you may opt out of the arbitration agreement by sending a clear written notice containing your full legal name and address via mail or email to contact@qazicenter.com.

17. Amendments & Entire Agreement

17.1 Right to Amend

QCC reserves the right to amend, modify, or update these Terms at any time. Changes are effective immediately upon posting to the Site. The "Last Updated" date at the top of this document indicates when the most recent changes were made. Your continued use of the Site, booking of appointments, or purchase of services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Site and our services immediately.

17.2 Entire Agreement

These Terms, together with our Privacy Policy, any separately signed Medical Informed Consent, and any procedure-specific consent forms, constitute the entire agreement between you and Qazi Cosmetic Center regarding your use of this Site and the purchase of our products or services. These Terms supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.

17.3 No Waiver & Assignment

The failure of QCC to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver shall be effective unless in writing signed by an authorized representative of QCC. QCC may assign its rights and obligations under these Terms without your consent. You may not assign your rights or obligations without QCC's prior written consent.

18. Limitation of Liability

To the fullest extent permitted by law, QCC's total liability for any claim arising out of or relating to these Terms or your use of the Site or services shall not exceed the total amount you paid to QCC for services in the twelve (12) months preceding the claim.

Under no circumstances shall QCC be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages. This includes, without limitation, patient travel costs, lodging expenses, airfare, lost wages, or missed business opportunities arising from rescheduled, delayed, or cancelled treatments.

Any non-medical legal action, arbitration, or claim arising out of or relating to these Terms, the Site, or business operations must be commenced within one (1) year after the cause of action accrues, or be permanently barred, overriding any longer statutory limitations periods under state law.

This limitation does not apply to claims for medical negligence, professional malpractice, bodily injury, death, fraud, willful misconduct, or violations of law that cannot be limited by contract.

19. Indemnification

You agree to indemnify, defend, and hold harmless Qazi Cosmetic Clinic DBA Qazi Cosmetic Center and its providers, officers, directors, shareholders, employees, agents, contractors, and staff from any claim, loss, liability, cost, or damage (including reasonable attorneys' fees) arising out of your breach of these Terms, your negligent or willful misconduct, or your failure to disclose accurate and complete medical history.

20. Force Majeure

QCC shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, government action or regulation, equipment failure, labor disputes, or third-party service interruption.
