Because we are a medical group, we are also required to comply with the Health Insurance Portability and Accountability Act (HIPAA). This means:

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

How to Exercise Your CCPA/CPRA Rights

We will verify your identity (and, if applicable, your agent’s authority) before fulfilling a request. We respond within 45 days (and may extend once by 45 days when reasonably necessary, with notice). We do not discriminate against you for exercising your privacy rights.

Verification Process: For security, we may request specific information to confirm your identity or authority before processing your request.

Appeal Rights: If we deny your request, you may appeal by emailing info@qaziclinic.com with “Appeal” in the subject line. We will respond in writing within 45 days.

We retain personal information only as long as reasonably necessary for the purposes described in this policy (and to meet legal, tax, and medical recordkeeping requirements). PHI/medical records are retained per healthcare laws and standards.

Text Messaging Consent and Compliance

Opting into Text Messages

By opting into any Qazi Cosmetic Center text program, you expressly consent to receive recurring marketing and/or transactional text messages that may be sent using an automatic telephone dialing system, an artificial and/or a prerecorded voice by phone calls, text messages, voicemails, and/or emails by or on behalf of Qazi Cosmetic Center, at the cell phone number you provide us. You consent to receive transactional, operational, or informational text messages at that phone number, including but not limited to order confirmations; appointment notifications; and follow-up communications. Kindly be aware that we might be unable to transmit messages to certain mobile service providers. Your consent to receive text messages is voluntary and not a requirement to purchase any products or services. Opting Out

To opt out at any time, you agree to text "STOP" to any text message you receive from us or by contacting us directly. You will cease receiving SMS notifications, although administrative messages related to appointments may still be sent or email info@qaziclinic.com to request removal from Qazi Cosmetic Center text message programs. Please note that if you have any service or treatment-based appointments with us, you will still receive appointment-related text message reminders as necessary, but will be opted out of marketing text messages. After opting out of receiving text messages, you can re-enroll in any Qazi Cosmetic Center text messaging program by following the same instructions for initial enrollment.


TCPA Compliance

We comply with the Telephone Consumer Protection Act (TCPA) by:

Eligibility and Mobile Phone Number

By opting in to any Qazi Cosmetic Center text message program, you agree that you are the account holder for the mobile telephone number(s) that you provide, and that you are the current subscriber or authorized user of the phone number(s) provided. You warrant that you are 18 years of age or older. You are responsible for notifying Qazi Cosmetic Center immediately if you change your mobile telephone number. You agree that you will not initiate messages to the mobile phone of any other person or entity without authorization. Failure to follow these guidelines constitutes a material breach of the SMS Terms and Conditions. Mobile carriers are not liable for delayed or undelivered messages.

Cost

Message and data rates may apply to any text messages sent to you from or on behalf of Qazi Cosmetic Center, as well as messages you send to us. These rates are determined by your mobile telephone service rate plan, and additional charges may apply for roaming. For further information regarding your pricing plans, we advise reaching out to your mobile telephone carrier.

No Guarantee of Access or Delivery

The delivery of information and content to a mobile device may encounter obstacles under various circumstances or conditions. Content availability may vary among carriers, and their participation may be subject to change. Qazi Cosmetic Center is not responsible for delayed or undelivered messages. You acknowledge that network services, including mobile network services, are beyond Qazi Cosmetic Center control, and we are not liable for any issues arising from them.

Mandatory Dispute Resolution (including Arbitration, Class Action Waiver, & Jury Trial Waiver)

Mandatory Arbitration. This section outlines the resolution process for disputes related to this Agreement or the Service. You and QAZI COSMETIC CENTER agree that disputes will be resolved through final and binding bilateral arbitration or small claims court. This agreement applies to claims under the Telephone Consumer Protection Act and other applicable laws. The Federal Arbitration Act governs this agreement, and arbitration is administered by the American Arbitration Association (AAA)’s Consumer Arbitration Rules. The arbitration decision is final and binding, subject to exceptions under the FAA, and enforceable in any court of competent jurisdiction. Unless agreed otherwise in writing, arbitration follows the AAA’s Rules. YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND QAZI COSMETIC CENTER ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. THIS AGREEMENT DOES NOT ALLOW FOR CLASS ARBITRATIONS EVEN IF THE PROCEDURES OR RULES OF THE AAA WOULD. RATHER, YOU AND QAZI COSMETIC CENTER ARE ONLY ENTITLED TO PURSUE ARBITRATION ON AN INDIVIDUAL, BILATERAL BASIS. FURTHER, AND UNLESS YOU AND QAZI COSMETIC CENTER AGREE OTHERWISE IN WRITING, THE ARBITRATOR(S) MAY NOT CONSOLIDATE MORE THAN ONE INDIVIDUAL PARTY’S CLAIMS WITH ANY OTHER PARTY’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR COLLECTIVE PROCEEDING.

Changes and Updates to Terms and Conditions

Qazi Cosmetic Center reserves the right to update these SMS Terms at any time without prior notice. By remaining enrolled in any Qazi Cosmetic Center text messaging program or by providing your cell phone number for transactional, operational, or informational text messages, you agree to any revisions. Any changes will become effective immediately upon posting on the Qazi Cosmetic Center website. It is your responsibility to review these SMS Terms periodically to stay informed about any updates. Your continued consent to receive Qazi Cosmetic Center text messages signifies your acceptance of the revised terms.
